From here onwards in this agreement, the term “PMSCT” refers to the website https://mahimdargah.org/, which owns this website.

This Terms and Conditions of Service (“Agreement”) between PMSCT and users/registered members of the website (“You”) describes the terms on which PMSCT offers you the Services (as defined below) through the website. The use of this website is governed by the terms and conditions under this Agreement. The facilities and services provided by PMSCT are as follows,

You are liable in the event you violate any of the terms and conditions of such a third party in making your donations. PMSCT shall not be responsible for any such errors or default in making your donations.

1.2  PMSCT is responsible for the cause to which you have donated. PMSCT shall make every effort to ensure that the donation is utilized for the purpose which is specified in the description.

1.3  Utilization of donations and Feedback reports: PMSCT strives to provide a feedback report on the utilization of donations made by you within reasonable time limits. The feedback report time period may vary depending on the nature of utilization of donation.

1.4  Tax exemption certificates: You are requested to go through the tax exemption details displayed in the content of every cause before you make the donation. PMSCT will ensure to send applicable tax exemption certificates to you within reasonable time limits.

Prohibited Activity

2.1  Services. You shall comply with all applicable laws, regulations and rules and undertake not to use PMSCT Services for any unlawful purpose or in a manner which is likely to cause harm or offend any other user including PMSCT.

2.2  PMSCT reserves the right to investigate and take appropriate legal action against anyone who, in PMSCT’s opinion, violates this provision, including, without limitation, reporting you to appropriate law enforcement authorities.

Governing Law/Dispute Resolution

8.1 The contract shall be governed in accordance with the laws of India and the Courts in Jamshedpur shall have the exclusive jurisdiction to try and suit proceedings in connection therewith/in that behalf. Any disputes under this agreement, which cannot be settled by negotiation, may be resolved exclusively by arbitration under the provisions of the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof. The Arbitration proceedings shall be held in Jamshedpur. The language of the Arbitration shall be English. The Courts in Jamshedpur alone shall have jurisdiction in the matter.
